If, after the application of these Forum of Dispute provisions, your claim is still ineligible to be heard in the Small Claims Court, you agree that the dispute shall be heard in the next most summary manner available in a court of competent jurisdiction.

If you bring a dispute in a manner other than in accordance with this section, you agree that we may move to have it dismissed, and that you will be responsible for our reasonable attorneys' fees, court costs, and disbursements in doing so.

You agree that the prevailing party in any dispute will be entitled to claim from the unsuccessful party the entire amount of the prevailing party's reasonable attorneys' fees, costs, and disbursements in relation to the dispute.

Disputes with Third Parties

You agree that if you take legal action against a third party, such as an employer or marketer who purchases information from us, in relation to Track5Media's services or the information provided by yourself to Track5Media, that you will bring the dispute against them in accordance with the Choice of Law and Forum of Dispute provisions of this Privacy Policy in the same manner that you would be required to against Business Charter Jet, to the extent permitted by applicable law. This is because in such cases one or more party may find it necessary to subpoena or summon Business Charter Jets as a witness, and we believe it to be most cost-effective for us and neutral to the parties involved if such a dispute is brought according to the same rules as those which would be applied to disputes with Business Charter Jets.

You agree that, should you bring a dispute contrary to this section and such a dispute is not dismissed for lack of jurisdiction, you will pay for Business Charter Jet’s reasonable travel fees and other expenses in travelling to any jurisdiction outside of the State of Pennsylvania.

Notice to Data Purchasers

If you are a User purchasing or otherwise receiving individuals' information from us, rather than a User who deposits it with us, you agree that you will take all steps necessary to comply with this Privacy Policy and any amendments to it, as well as the applicable law, regardless of whether you reside in the State of Pennsylvania or elsewhere.
